El Tribunal Supremo de Estado Unidos ha reafirmado recientemente la normativa vigente del DHS (Departamento de Seguridad Nacional) para permitir a los estudiantes extranjeros con visado F-1 para que trabajen en USA después de graduarse por un período de hasta tres años a través del programa OPT (Entrenamiento Práctico Opcional) del DHS. A través de dicha resolución, el poder ejecutivo está plenamente facultado para otorgar elegibilidad laboral a aquellos estudiantes internacionales que lo soliciten.
Los estudiantes que apliquen al OPT con visado F-1 son elegibles para trabajar para una empresa americana durante un período máximo de 12 meses después de su graduación, y aquellos estudiantes que se hayan graduado de carreras STEM (ciencia, tecnología, ingeniería y matemáticas) podrán solicitar una extensión adicional de 24 meses, conocida como OPT STEM, pudiendo trabajar en América un total de 3 años como mínimo.
Como resultado, el DHS ha publicado una lista de carreras STEM a efectos de la extensión opcional OPT STEM de 24 meses adicionales.
Dicha lista designa los siguientes cuatro bloques de carreras STEM: Ingeniería, Ciencias Biológicas y Biomédicas, Matemáticas y Estadísticas, y Ciencias Físicas. Según se ha anunciado, la lista será ampliada automáticamente con nuevas adiciones de programas de grado.

- International students graduating from one of the below-mentioned STEM majors will automatically receive a 3-year work permit.

The Supreme Court of the United States has recently reaffirmed the current regulation of the DHS (Department of Homeland Security) to allow foreign students with an F-1 visa to work in the USA after graduation for a period of up to three years through the DHS’s Optional Practical Training (OPT) program. Through this resolution, the executive branch is fully empowered to grant work eligibility to those international students who apply for it.
Students applying for OPT with an F-1 visa are eligible to work for an American company for a maximum period of 12 months after graduation, and those students who have graduated from STEM (science, technology, engineering, and mathematics) majors may apply for an additional 24-month extension, known as STEM OPT, allowing them to work in America for a total of at least 3 years.
As a result, the DHS has published a list of STEM majors for the purpose of the additional 24-month STEM OPT extension. This list designates the following four blocks of STEM majors: Engineering, Biological and Biomedical Sciences, Mathematics and Statistics, and Physical Sciences. As announced, the list will be automatically expanded with new additions of degree programs.
The list also includes the following career series: Agricultural/Animal/Plant/Veterinary Sciences and Related Fields; Natural Resources and Conservation; Architecture and Related Services; Communication, Journalism, and Related Programs; Communication Technologies/Technicians and Support Services; Computer and Information Sciences and Support Services; Education; Engineering/Engineering-related Technologies/Technicians; Military Science, Leadership, and Operational Art; Military Technologies and Applied Sciences; Multi/Interdisciplinary Studies; Science Technologies/Technicians; Psychology; Homeland Security, Law Enforcement, Firefighting, and Related Protective Services; Social Sciences; Transportation and Materials Moving; Health Professions and Related Programs; and Business, Management, Marketing, and Related Support Services.
